JUDICIALIZAÇÃO DA SAÚDE E SEUS REFLEXOS NA ASSISTÊNCIA ONCOLÓGICAS

Abstract

The judicialization of healthcare is a growing phenomenon in Brazil, especially in the context of oncological care, an area marked by the high complexity of treatments, high costs, and the constant incorporation of new technologies. This study aimed to analyze the judicialization of healthcare and its effects on oncological care, considering its impacts on access to services, the management of the Unified Health System (SUS), and the equity of care. This is an integrative literature review, conducted in the databases Scientific Electronic Library Online (SciELO), Virtual Health Library (BVS), Latin American and Caribbean Literature in Health Sciences (LILACS), and Medical Literature Analysis and Retrieval System Online (MEDLINE/PubMed), using descriptors defined according to the Health Sciences Descriptors (DeCS). The results showed that judicialization, although acting as an instrument to guarantee the fundamental right to health, reveals weaknesses in public policies and in the organization of oncological care, especially regarding access to high-cost medications and innovative therapies. It was also observed that judicial decisions tend to prioritize individual demands, which may compromise the planning of services and the equity of the system. It is concluded that the judicialization of health, in the context of oncology, requires coordinated strategies between public authorities, strengthening of oncology care policies, and improvement of technological incorporation processes, aiming to ensure comprehensive, equitable, and sustainable care within the SUS (Brazilian Unified Health System).
