Civil Liability and Ethical-Legal Management in Dentistry: Strategies for Litigation Prevention
ABSTRACT
Dental practice has become increasingly exposed to legal actions, especially after the strengthening of patient rights through the Consumer Protection Code. In this context, dentists must act with ethics, technical competence, and legal awareness to prevent litigation and ensure a secure professional-patient relationship. This study aimed to analyze the legal and ethical aspects of civil liability in dentistry, highlighting ethical-legal management and dental records as strategic tools for legal prevention. The research was conducted through a literature review, selecting articles published between 2020 and 2025 in Portuguese, English, and Spanish. After screening 47 studies, 12 were analyzed qualitatively, focusing on professional practices that reduce legal risks. It is concluded that preventing litigation in dentistry requires more than technical skills. Good communication with the patient, compliance with legal standards, and properly maintained dental records are essential for the legal protection of dentists. The dental record, in addition to being a clinical document, is a key element of professional defense, contributing to the value of dental practice and the development of trustful relationships with patients.
